Terms of service
These terms govern your use of tcgprime.store and any order you place through it. By using the site or buying from us, you agree to them.
1. Who you are contracting with
tcgprime.store is operated by TCGPrime, a trading name, of 1630 N Congress Ave, West Palm Beach, FL 33401, United States. "We", "us" and "our" mean that business. "You" means you.
2. Eligibility
You must be at least 18 and able to enter a binding contract. By ordering you confirm that the payment method is yours or that you are authorised to use it.
3. Products, descriptions and images
We describe every product as accurately as we can, including configuration, release year, language and — for graded cards — the grade and certification number.
- Product photographs are representative of the item and its configuration. For sealed product they show the configuration, not the specific unit; the unit you receive is an equivalent sealed item of the same product.
- For graded slabs and single cards, the photograph is of the actual item. What you see is what ships.
- Colours vary between screens.
- Packaging design changes between print runs at the manufacturer's discretion.
3.1 Odds, hits and pull rates
Sealed trading card product is sold as sealed product. Any odds, insert rates or "hits per box" figures come from the manufacturer, are averages across a print run, and are not a promise about your box. We make no representation about the contents or resale value of any sealed item, and an outcome you did not want is not a defect. See our returns policy.
3.2 Third-party trademarks
Panini, Topps, Bowman, Upper Deck, Leaf, The Pokémon Company, Wizards of the Coast, Bandai and all other brand names, logos and product names are the property of their respective owners. We are an independent retailer. We are not affiliated with, endorsed by, or sponsored by any of them, and we use their names only to identify the products we sell.
4. Prices and payment
- All prices are in US dollars and exclude sales tax, which is calculated at checkout where we are required to collect it.
- Prices change with the market and may change without notice. The price that applies is the one shown when you complete checkout.
- Payment is taken at checkout.
- We do not display a struck-through comparison price unless it is a price we genuinely charged or a manufacturer's published MSRP.
4.1 Pricing errors
Occasionally an item is listed at an obviously incorrect price. Where the error is manifest, we may cancel the order and refund you in full even after confirmation. We will tell you promptly, and you are of course free to reorder at the corrected price.
5. Orders and acceptance
Your order is an offer to buy. The contract forms when we send a dispatch confirmation, not when the order confirmation arrives. Before dispatch we may decline or cancel an order — with a full refund — where:
- the item is unavailable or the supplier cannot fulfil it;
- there was a pricing or description error;
- the order fails fraud screening or address verification;
- we reasonably believe the order is for resale in breach of a supplier agreement, or is being placed to circumvent purchase limits.
5.1 Purchase limits
On allocated releases we may limit quantities per customer, per household or per payment method. Where a limit applies it is stated on the product page.
6. Stock
Everything listed is physically on our shelf. We do not sell backorders or sourced-to-order items, and when a line sells out it comes off sale rather than remaining buyable with an unconfirmed ship date.
Stock counts update continuously, and in rare cases an item sells twice before the count catches up — where that happens we cancel and refund in full immediately.
7. Delivery and risk
Delivery terms are in our shipping policy, which forms part of these terms. Risk of loss and damage passes to you on delivery to the address you gave us. Title passes when we receive payment in full.
8. Returns
Our returns policy forms part of these terms. In short: unopened sealed product can come back within 30 days; opened sealed product cannot. Nothing in these terms affects your statutory rights.
9. Accounts
You are responsible for keeping your password confidential and for activity under your account. Tell us immediately if you think it has been compromised. We may suspend or close an account used for fraud, abuse of staff, or repeated chargebacks made without contacting us first.
10. Acceptable use
You agree not to:
- scrape, mirror or systematically copy the site's content, pricing or images;
- use automated tools, bots or scripts to place orders or bypass purchase limits;
- attempt to interfere with the site's security or availability;
- submit false information, or use a payment method you are not authorised to use.
11. Intellectual property
The site's design, text, product descriptions, photography and code are ours or our licensors', and are protected by copyright. You may not reproduce them commercially without written permission. Third-party trademarks remain with their owners as set out in clause 3.2.
12. Limitation of liability
Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, and to the maximum extent permitted by law: we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or any loss connected with the resale value or investment performance of anything you buy from us. Our total liability for any order is limited to the amount you paid for it.
13. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including carrier disruption, severe weather, supplier failure, industrial action, or a manufacturer's decision to delay or cancel a release.
14. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You and we submit to the exclusive jurisdiction of the state and federal courts sitting in Palm Beach County, Florida.
There is no compulsory arbitration clause and no class-action waiver in these terms. If you have a complaint, email us first — it is faster than any of the alternatives, and it is what we would rather do.
15. Changes to these terms
We may update these terms; the version that applies to your order is the one published when you placed it. The date at the top shows when they last changed.
